TERMS & CONDITIONS

By accessing this website or purchasing any product from SecondHandMobilityScooters.co.uk, you confirm that you have read, understood and agreed to these Terms and Conditions in full. These Terms govern all sales and interactions between you (the customer) and us (the seller) and constitute a legally binding agreement. All mobility scooters sold through our website are second-hand items which have been previously owned and are professionally cleaned, serviced, and health and safety tested prior to dispatch. As used goods, they may display minor cosmetic wear, scratches or marks consistent with prior use, and the buyer acknowledges and accepts this as part of the nature of purchasing refurbished mobility equipment. Each product is sold as described and as seen in the accompanying images and description.

All listings on this website display the actual mobility scooter being sold, and the buyer will receive only what is shown in the listing images. Every purchase includes the mobility scooter and a compatible power charging cable. No additional accessories, parts or attachments are included unless they are specifically mentioned in the product description. Any accessories visible in images but not referred to in the listing text are not part of the sale. All descriptions, photographs, measurements, and specifications are provided in good faith, but minor discrepancies or typographical errors shall not give rise to any right of cancellation or claim.

By placing an order with SecondHandMobilityScooters.co.uk, you agree to be bound by these Terms and to purchase the product subject to the conditions herein. Orders are subject to stock availability and acceptance by us. We reserve the right to decline or cancel any order at any time prior to dispatch, including in cases of pricing or listing errors. All prices are shown in GBP (£) and include VAT where applicable. Payment must be made in full at the time of purchase using our secure online checkout system. We reserve the right to change prices and product availability without prior notice.

Delivery will be arranged to the address provided by the customer at checkout. Delivery times may vary depending on location and courier schedules. Title and risk in the goods shall pass to the customer upon full payment and delivery. It is the customer’s responsibility to ensure that the delivery address provided is accurate and that someone is available to accept delivery. We cannot be held responsible for delays or failed deliveries resulting from incorrect or incomplete address information. Any visible damage or issue must be reported to us immediately upon receipt of the product.

In accordance with the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, customers purchasing online have the right to cancel their order within fourteen (14) calendar days from the day after receiving the goods, provided that the scooter is returned to us in the same condition as received and has not been used or altered. The buyer must notify us in writing (by email) of their decision to cancel within the 14-day period. Return costs are the responsibility of the buyer unless the item is faulty or not as described. Once we have received and inspected the returned scooter, a refund will be processed to the original payment method, less any deductions for damage, wear or missing items. After the 14-day cooling-off period has expired, returns will only be accepted at our discretion or if the product is faulty within the meaning of the Consumer Rights Act 2015.

We take care to ensure that every scooter is in full working order prior to dispatch and meets safety and performance standards appropriate to its type and age. However, as used goods, the scooters are sold “as described,” and no representation or warranty is made beyond the functional condition stated in the product listing. To the maximum extent permitted by law, we exclude all warranties, express or implied, relating to the fitness of the product for any particular purpose. The customer is responsible for ensuring that the scooter is suitable for their needs and that they operate it in accordance with local laws, safety standards and manufacturer guidelines.

SecondHandMobilityScooters.co.uk shall not be liable for any injury, accident, loss, damage or expense arising from the misuse or improper operation of any mobility scooter purchased from us. Our total liability for any claim arising out of a sale shall not exceed the price paid for the product in question. We shall not be liable for any indirect, consequential or incidental damages, loss of use, or loss of profit. Nothing in these Terms shall limit or exclude liability for death or personal injury caused by negligence, or any other liability that cannot be excluded under UK law.

We reserve the right to amend, update or replace these Terms and Conditions at any time without prior notice. Any changes will take effect immediately upon being posted on this website, and it is your responsibility to review them before making a purchase. Continued use of our website following any change constitutes acceptance of the revised Terms. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain valid and enforceable.

These Terms and Conditions are governed by and interpreted in accordance with the laws of England and Wales, and any disputes arising under them shall be subject to the exclusive jurisdiction of the courts of England and Wales.
